CIWS PETITION

PREAMBLE:
The Federal Government of Canada is under international treaty obligation to ensure that workers compensation is being provided to Canadian workers. The North American Free Trade Agreement (NAFTA) stipulates* that the signatory countries must uphold "high labor standards" and includes in this, "compensation in cases of occupational injuries and illnesses". *under its side agreement NAALC, the North American Agreement on Labor Cooperation


IN ADDITION, the Federal Government of Canada is under international treaty obligation to ensure compliance with the United Nations Convention on the Rights of the Child - specifically Part1, Articles 19, 26, 27, 36 encompassing provisions such as ". . . effective procedures for the establishment of social programmes to provide necessary support for the child and for those who have the care of the child" and ". . . appropriate measures to assist parents and others responsible for the child to implement this right and shall in case of need provide material assistance and support programmes, particularly with regard to nutrition, clothing and housing"

IN ADDITION, the Federal Government of Canada is signatory to the UN Convention on the Rights of Persons with Disabilities http://www.un.org/esa/socdev/enable/conventioninfo.htm


THEREFORE:
The Canadian Injured Workers Society (and IWAAC) is calling upon all concerned Canadians to sign the following petition calling for a FEDERAL PUBLIC JUDICIAL INQUIRY into wrongdoing by workers compensation systems across Canada.

We must continue to inundate the public, media, politicians and governments at both levels, of the atrocities the WCBs perpetrate on D/W's, especially those that have permanent disabilities

Social Justice for the Disabled by Occupation Worker (D/W) & Family Members

" It cannot be said that the Board is independent insofar as the worker is concerned. It is a Board set up to protect the employers. The Board is funded by the employers, and the Board has a duty and probably a primary duty to protect the employer. In relation to the worker, the Board has an overwhelming wealth of knowledge and experience. It has the financial ability to fund sophisticated investigations involving highly qualified experts and have the material presented to them, guided, orchestrated and propounded by its in-house counsel responsible to the Board and paid for by the Board. The application of any standards under the rules of natural justice would identify such circumstances as being unequal in negotiating ability and unfair. This is not a level playing field, it is not fair, and it offends the basic principles of natural justice."

A Doctor Writes:

"I experienced some feeling of pressure from the WCB in relation to one of my cases. After submitting my report, I received a letter from Dr. Kevin A. Bourke, Medical Adviser, Central North Shore, informing me that he would not process the invoice for my fee unless I edited my report to conform to his desires. Fortunately, unbeknownst to him, I had already received my fee. I, of course, did not edit my report. But I did inform him of the rationale for the recommendations that I had made. I might say that I was somewhat affronted that a WCB staff member would request that an independent professional change her report in order to conform to the board's wishes and in particular, threaten to withhold payment."

Dr. Bourke is currently (as of 2006) Chair and Chief Examiner of the College of Physicians and Surgeons of Nova Scotia's Clinician Assessment for Practice Program (CAPP) Examination Committee, which evaluates international medical graduates for defined licensure in Nova Scotia.

Health

HEALTH, (the negative social determinants of population and mental health), is the 'achilles heel' of the of the workplace safety insurance board and the all the other compensation boards across Canada.

Write your respective Minister's of Labour and ask why the provincial government is complicit in allowing further physical, mental, psychological and emotional harm come to disabled workers.

Always speak your heart.
